DMCA Agent Procedure for Receipt of a "Take-down" Notice

  • Consult the Grand Unified Lookup for recent use of the infringing IP address.
  • Confirm that the infringing IP was in use at the reported time of the alleged infringement.
  • Determine the registered user of MAC address corresponding to the infringing IP at the time of the reported infringement.
  • Forward the Take-down notice to the registered user along with instructions to:
    • remove the infringing file(s) and filesharing software
    • reply to USU's agent confirming the removal.
  • Disable in IPAM the MAC address associated with the infringing IP
  • Reply to the plaintiff that the registered user has been identified and contacted and the infringing IP has been released for reassignment.
  • The registered user is NOT identified to the copyright owner.

Response by Infringing User

  • Locate the infringing file (and similar files)
    • If found:
      • Remove the infringing file(s)
      • Remove the P2P filesharing software
      • Reply to USU's agent with confirmation
      • Pay $50 reconnect fee - a cost recovery fee for time to deal with the infringement notice
    • If not found:
      • file a counter claim asserting that the facts of the take down notice were incorrect
