DMCA Agent Procedure for Receipt of a "Take-down" Notice
- Consult the Grand Unified Lookup for recent use of the infringing IP address.
- Confirm that the infringing IP was in use at the reported time of the alleged infringement.
- Determine the registered user of MAC address corresponding to the infringing IP at the time of the reported infringement.
- Forward the Take-down notice to the registered user along with instructions to:
- remove the infringing file(s) and filesharing software
- reply to USU's agent confirming the removal.
- Disable in IPAM the MAC address associated with the infringing IP
- Reply to the plaintiff that the registered user has been identified and contacted and the infringing IP has been released for reassignment.
- The registered user is NOT identified to the copyright owner.
Response by Infringing User
- Locate the infringing file (and similar files)
- Remove the infringing file(s)
- Remove the P2P filesharing software
- Reply to USU's agent with confirmation
- Pay $50 reconnect fee - a cost recovery fee for time to deal with the infringement notice
- If not found:
- file a counter claim asserting that the facts of the take down notice were incorrect
